Temporary Orders

In the temporary orders I agreed to pay child support of $1120 and pay our 2007 chevy tahoe note each month. Just recently my contract ran out where I work and my hourly rate has now been lowered back down to what I orrigianly was hired in at. I can no longer afford the Tahoe note but I do not want to get behind in child support. They will throw you in jail. I live in Houston Texas. Can I stop paying the 2007 chevy tahoe and get my wife to pay it. I have all the house bills she left me with and I do not want to start having the house and other vehicle repoed. Keep in mind during temporary orders she agreed to go to counseling. She went by herself as agreed but has still not gone to our couples counseling session. She keeps putting it off. This is also part of the temporary orders for us to go.

If her failure to attend couples counseling is causing problems with visitation or the children, you might have a point. Just because she is not going is a technical violation, but not connected to the Tahoe. You will have to go back to Court to get the Temp Orders modified. Your change of circumstance will have to be documented. An Affidavit from the employer would likely be sufficient.
