Legal Question in Civil Litigation in Texas

Claim Against Allstate

I was rear ended in Feb of 2007 by a client insured by Allstate. As a result of the accident, I had to repeat injections to my back that had been done the week before. Prior to the last injection, it had been 7 yrs. Allstate offered me 2500 of which I would have to give Blue Cross, my medical insurance-1500.00. They claim they would give me 1000 for pain and suffering-this is not really even enough to pay the copays that I paid. I told them no, but I am not sure it would be worth it to turn it over to lawyer. The man who rear ended also had another accident the day before.

Re: Claim Against Allstate

If it was a minor accident..proof of more damage sounds difficult..but in small claims you can get $5000...and you may have PIP to get more money...

most lawyers do not accept cases for minor injuries
