Legal Question in Employment Law in Texas

Fired for staying home with sick child

My sister's husband was fired for staying home one day with their sick child. They told him that if his wife's job was more important that she should support the family. Is this discrimination? Is this illegal?

A1: Maybe. A2: Maybe.

If your husband and the employer are covered by the FMLA, it is illegal for the employer to terminate him because he took medical leave to take care of an immediate family member. The Department of Labor in your city may accept your complaint and investigate it.
