Legal Question in Employment Law in Texas
Retaliation for accidents on the job.
The company that I work for is retaliating against associates that have on the job accidents. They are being written up (coached). Also if it ends up that it cost the company money than you ar given a D-day. That is basically stating that your job is on the line, they give a paid day off and when you get back they decide wether or not to terminate that emplyee. Its goes in a permanent record and keeps you from getting any promotions, or transfering to another store for a year. Is this legal?

Re: Retaliation for accidents on the job.
It could be against the Texas Labor Code if your company has Worker's Compensation. If your company is a non-subscriber to Worker's Compensation and has an ERISA-regulated Accident and Injury Plan then it may be illegal under ERISA.
What is the name of the company before we go any further.
