Terminated Employees Rights

Am I entitled to the quarterly bonus? I was employed the full quarter and was terminated shortly after the quarter ended. There are several issues that I have with this company (sexual harassment included) and would really like to persue some kind of legal action. I have many witnesses to the unjust treatment I received while employed there. Where do I start?

Any entitlement to a quarterly bonus will be governed by the employer's policy. If it is not in writing, you may still be able to be compensated, but it would be difficult. There is no entitlement to the bonus if it is not in accordance with company policy.

I would urge you to contact an employment lawyer immediately on the sexual harassment issue to determine your rights and to seek resolution. "Unjust treatment," however, without more, will not likely be sufficient to pursue a claim, unless you can show it was substantial and it was gender-based.

Look in your new hire package or employee handbook to determine if the quarterly bonuses were promised to you in writing. If it is in writing, you should talk to an attorney regarding legal action to recover the last quarterly bonus.
