It depends on (1) the amount of injuries, (2) the amount of available insurance or assets and (3) the amount of liability of the other party. Regardless of how "cut and dried" the facts may appear, wrangling a satisfactory settlement out of an insurance company in these days of "tort reform" is not easy, nor is it something you are likely to be able to do on your own.
