Legal Question in Personal Injury in Texas

If I were injured in a auto/bicycle accident, I was on the bicycle and the auto was at fault, and the driver had only the state minimum insurance and my health insurance paid my medical bills, could I settle with her insurance before my insurance carrier? Will my insurance carrier try to get me to give them the settlement? I shouldn't be out money due to her sucky insurance and I pay for my health insurance.

Yes, your health insurer will try to get as much of your settlement as it can. Often a client's health insurer will reduce its lien to allow for attorney fees. If you hire an attorney, you might be able to get some cash. I have helped clients get cash when they have had large health insurance liens. Please let me know if I can help.

I represent clients throughout Texas. Also, I'm a cyclist!
