Legal Question in Personal Injury in Texas

Injured and other driver had no insurance that we know of

I was in an auto accident. The lady that hit me admitted it was her fault. Well she ''said'' she had full coverage, PIP, etc. I hired an attorney to deal with the insurance company. My attorney called me yeserday and said that the company she claims to have it through said she doesn't. My son and I are injured and still need a lot of medical care. I am so mad. My attorney said if she doesn't have it they will not continue on the case. What should I do now? I know she does own a small business here in town. I was thinking of taking her to civil court but they said yu need an attorney to file there and I am a single mother going through a divorce and don't have the funds for that type of case. Please please help us. We still need to get the medical attention we deserve and we are far from better. I am just so overwhelmed right now. I thought things were going good with this and then we find this out. All help would be much appreciated.

i think the first thing to do is to ask your attorney for a copy of written verification as to the existence of liability insurance on the part of the lady that hit you. if she in deed does not have liability coverage then you have the right to seek compensation from your own auto insurance company for uninsured motorist benefits, assuming that you have that coverage. i would discuss this with your attorney. if you do not have uninsured motorist coverage you will need to ascertain from your attorney the merits of proceeding with the case against the lady to obtain and collect on a judgment. i hope this helps. bill featherston
