Legal Question in Real Estate Law in Texas

My fiance and I were living together and in the process of moving. We had an argument and she told me she needed space and wanted me to leave. I just grab a few clothes and left quickly so the argument would not escalate. I am at my mom's house now and she has moved and taken my things and will not return them to me. I have horrible eyesight and have a years worth of contacts and all of my clothes and mail that I need. She will not give me my things. What action can I take to get my belongings and how long is the process. We also have a daughter she will not let me see because I will not live with her.

Sue her for the tort of conversion. You should send her a demand letter first (paper letter - put a date on it, and keep a copy).

In the alternative, you could take the position that you and she were informally married (often referred to as "common-law marriage," which is a misnomer). You would sue her for divorce, and ask for temporary orders that would give you temporary possession of your stuff AND temporary custody of your child.

It sounds to me like you're better off without her.
