Legal Question in Real Estate Law in Texas

Liability for Leak in Condo Damaging Condo Next Door

I had a leak in my condo that damaged the condo next door to mine. Based on our by-laws, I was responsible for fixing/replacing the damaged parts of the condo itself. I have made the repairs to the owner's satisfaction. Now the tenant in that condo is threatening to sue for damages done to her personal property. Am I liable for the contents?

Please respond quickly, as I might be facing a court date much sooner than I anticipated.

Thank You,

Re: Liability for Leak in Condo Damaging Condo Next Door

You might well be liable on either negligence or another theory. Do you have homeowner's insurance? It's likely that you do if your condo is mortgaged; your carrier will likely have to defend and indemnify you in this matter.
