Who is consider next of kin

My father died leaving no will. He had owned a parcel of land in Texas. I have two deceased siblings which died several years before my father. I have two living siblings. The three of us (living) are wanting to sell the land rather than continue to maintain it. Are we the living, considered the legal heirs or do my deceased siblings children have a share.

The deceased siblings' children may have an interest as well. You also didn't mention a spouse of the deceased, as the spouse may also hold an interest in the parcel. These are relatively minor matter that can likely be corrected with some simple paperwork.

Assuming that your father was a single man when he died, the children of your deceased siblings would inherit their parent's 1/5 share.
