Legal Question in Disability Law in Utah

PTSD Employment Discrimination - Utah

About a month ago I was fired from my job at a large company. I was never late to work, often came in for extra hours, received numerous compliments from internal customers and I thought I was doing a decent job.

However, I had problems following through on tasks, forgetting customer requests and took too long to complete some assignments.

I was diagnosed with possible PTSD by the company EAP counselor and was using suggested coping mechanisms to enhance my performance after being put on a performance improvement plan.

My PTSD was the result of combat experiences while serving in OIF. I am well qualified for the position and asked for accommodations to continue employment. My boss cited that the department was under close scrutiny by corporate executives and could not afford any mistakes I might make in the future. They then proceeded to fire me after 1.5 years of employment.

I have been formally diagnosed with PTSD and have filed a claim for disability with the VA.

My question is this: Did my employer discriminate against me by not allowing accommodation for PTSD?

I will provide additional info if necessary.

Re: PTSD Employment Discrimination - Utah

Your employer was obligated to provide reasonable accommodations for your disability under the Americans with Disabilities Act. You can sue for your lost pay and to get your job back.
