Legal Question in Family Law in Utah

Changing Custody and Child Support

I was divorced 10 years ago and have joint custody of my children. We agreed to me taking custody of them at least for this year 80% of the time. I stopped paying child support and have not asked them to pay it to me through a verble understanding not paperwork signed at this time. I am running into problems with them assisting me in paying medical costs for the children so I am considering asking for child support.

What do you recomend I do?

Re: Changing Custody and Child Support

Verbal agreements between the parties are not enforceable. You must return to court to get a new court order with the changes you want. You should get child support - by law it is required. I suspect your ex is willing to allow you to have custody if he does not have to pay. If true, good reason to divorce him.
