Legal Question in Landlord & Tenant Law in Virginia

I rent a house from my ex husband and in turn rent out the individual rooms fully furnished and pay all utilities. I had the guy sign an agreement that he would vacate if the rent was more than 7 days past due - and he refuses to pay or leave - do I have to go through the whole eviction process ? Virginia
