Legal Question in Real Estate Law in Virginia

Transfer of Deed

My father purchased a resort property 30+ years ago. Finance company paid in full - deed never transfered to his name. Indian Acres Land Company was sold several times. I have not been able to locate any one with knowledge of property sales ir location of documents. My research in the resort's admin office, and County tax office do not have a deed filed. However, dad has maintained property taxes since purchase. Requested checking account records during the finance period to acertain the financer. What else can I do prior to obtaining an attorney?

Re: Transfer of Deed

You could hire a title searcher to run a title search. Be advised that Maryland is a race notice state with

regard to recordation so the title searcher will have to run an appropriate search for this. Most reputable title companies know

how to handle this.

See if the bank will run copies of the checks going back 30 years from micro film. They will charge you for this.

But most important, do not delay in filing a notice of interest in the Circuit Court of the county where the property is located. Hire a local attorney to assist you.
