Legal Question in Sexual Harassment in Virginia

how to bring about a case for sexual harassment

One of my superiors has made repeated attempts to flirt with me and has touched me physically but not in my private areas. He is constantly trying to flirt with me and when I deny his advances he acts unfairly toward me. Yesterday, said I have a pretty neck bet I have never been choked. Then he hit me twice on my shoulder and then in my face. I told my superior on duty and he told me qoute ''Well, he does do alot for us here.'' I feel I have no backing at my job and feel they might try to fire me if I continue to press on .

Re: how to bring about a case for sexual harassment

Sounds like you might have a viable claim for a violation of federal law based upon sexual harassment in the your workplace environment. However, to "nail it down" so to speak, you may need to wait until some verifiable adverse action(s) have been taken against you that are likely reasonably related to your failure to accommodate

this "superior" or to play along with his flirtatious behaviour. Such adverse actions could be a failure to receive a promotion for which you had reason to believe that you were qualified for, an involuntary transfer to another position with a possible reduction in salary, failure to receive a scheduled salary increase in your current position, etc., are but a few examples that might apply.

You should keep careful records of any occurrences/events that might have a bearing on your claims.
