Legal Question in Credit and Debt Law in West Virginia

How to search for a person's assets to collect a judgement

How can I search for a person's assets in FL and WV? We received a judgement for terrible work done on our home. The judgement was for $39,000+ and we have already payed our attorney $6,000. We want to do the research ourself to see if the contractor has anything to collect. We cannot afford to pay the attorney more than we were awarded. I know the party has dealings in both states. I did some research on myfloridacounty.com but I need to know about bonds, motor vehicles and anything else.I know about the recovery fund in FL but we need the rest before we go anywhere with that. Thank you for any information you can give me.

I can't speak as to Florida. In West Virginia, a judgement creditor can subpoena the debtor in to a deposition and ask him or her under oath where the assets are. Beyond that, the DMV will search for a fee of $15.00 and each county has records of real estate conveyed to the debtor. It is possible that a lawyer will accept a collection assignment of your case on a contingency. You should at least consult counsel to determine what steps are necessary to perfect a lien on both real and personal property. Tom Z
