Legal Question in Family Law in Alaska

My son is under custody of his mother, although he hasn't lived with her for some time and I get charged with charged child support. His grandparents claim they have adopted him. Why am i still being charged with child support and can I obtain custody of him?

Are you, the grandparents, and the child all living in Alaska?

It is extremely unlikely that the grandparents would have been able to adopt him, and especially without your being given notice of the adoption petition. I suspect that when they say "adoption" they are speaking figuratively or informally.

If they mean that they have formally adopted him, ask for a copy of the adoption decree. With this, go to the courthouse and ask to see the court file on the adoption. You will be told that adoption files are sealed, but you should be able to see it nevertheless since you would be the (former) legal father.

If they have somehow adopted him, you are no longer obligated to pay child support.

Should you hit a snag, contact me and I will be pleased to help you.
