Legal Question in Employment Law in California

fired but no check yet

I was recently dismissed from my job on 11/3/08 now its 11/11/08 and still have not received my check.

I talked to my former supervisor on 11/7/08 and he told me he sent my check back because they told him I got paid one month in advance because I was a consultant, now he knows very well that I get paid on the 1st every month for the previous months work.

I want some advise on what to do.

If you're not timely paid, file a claim with the Labor Commissioner.

You are entitled to your check per labor code 203 on the day you are terminated. Your former employer has an exposure of 30 days additional pay for penalties by not paying you. for further information, visit my website at www.californiawagelawyer.com.
