Legal Question in Family Law in California

Prenuptual agreements

I have 100% custody of my 4 year old daughter. My exwife and I are thinking of reuniting. Can I ensure my continued custody of our daughter in the event of a future divorce via a prenuptual agreement?

Reply: Prenuptual agreements

No. A pre nuptial agreement addresses the issue of assets and debts, and not child custody. Child custody can not be made non-modifiable.

Good luck to you!
