Legal Question in Employment Law in California

Legal rights of Independent Contractors

My husband is an independent contractor (computer training). The company he contracted through for several months owes him a little over $7200.00 which is now over 90 days past due. I realize that he is not protected under Labor/Employement laws so what actions can he take to collect. We have called and emailed this company but they refuse to return them. Their late and non payments have put us in finacial hardship.....(late fees, possible reposetion, credit blemishes etc)....Can they be held liable for any of this? Thanks

Re: Legal rights of Independent Contractors

You can sue for breach of contract for the amount owed, plus interest. If you limit your claim to $5000 you can file it in small claims.
