Legal Question in Immigration Law in District of Columbia

permanent green card

thanks for taking your time to answer my question. i'm on conditional green card and the time is actually coming up to be able to apply for removal. my husband and i are separated, both of us live with a new partner for a while, he even moved out to another state (to several diffent places in the last year). they are expecting a baby adn we are thinking about it, too. so i don't know what to do. to get divorced and remarry would be my favorite option but do i really have to go through everything with my new partner? ( i mean starting out with filing everything again...) plus will i be out of status and have to stop working or just wait and file jointly for removal with my husband who would not mind staying married and doing it. i still have some bill on our names (only one actually) and he uses our address sometimes, too. we are on good terms but barely will have enough proofs for immigration, no joint anything almost. i don't want to risk anything because i know with my new partner i don't have to be worried at all. pls help me to make the right decision. thanks.

You may apply for an immediate waiver of the joint-filing requirement and request the removal of the condition on your permanent residence as soon as your divorce is finalized.
