Legal Question in DUI Law in Florida

Probation Violation(technical/failure to complete)

I plead no-contest to 1st DUI charge. I was placed on probation. I failed to complete the probation(failed to pay all the fines, complete community service, and moved without permission.) How do I remedy this situation and put myself right with the law and what sort of penalty will I face?

Re: Probation Violation(technical/failure to complete)

Hello: I just read your question. Basically, you need to start completing the requirements and putting aside the $ for the fines. It looks great to the court if you come in and say you've completed those things.

There probably is a capias in the system for your arrest. If you get an atty., he or she can call the judge and ask for a court date and to recall the capias.

If you don't have enough information on the remaining requirements and/or the amounts of $, you can call the probation office. If you are in a hurry to get the capias recalled, you can do that and get the court date without completing all of the prior requirements. The court, at least up here in North Fla., will pass the case for a month or so, so that you can come back after everything is completed. As for the sentence, if everything is ultimately completed, the court will just terminate probation and, most likely, not punish you further.

'Hope this helps. Tom Rosenblum.
