Name Change

I will be attending a court hearing soon regarding my ex's visitation with our daughter. WHile there, can I request that she change her last name (mine) back to her maiden name or does she have to agree? She and her actions have disgraced my family. She only sees our daughter 4 days per month so she can't say she wants to keep it because of her. ALso, she is now pregnant with her current boyfriend's child. Can she give this child my name even though we're divorced? I don't think she would but I'd like the heads up. THanks

When you and your ex-wife got married she was given your last name. That name became her name since she choose to take it upon her marriage to you. That is now her name unless she decides to change it. This last name can be given to subsequent children that she may have however, I would assume that her new boyfriend would want his name for the child. However, that would be between her and him.
