time to file a motion for summary judgment

I would like to file a motion with the court for a Summary Judgment due to recent telephone conversation with an attorney. My scheduled court date is 10/23. Is it too late to file for Summary Judgment? Are there any alternatives?

yes . . . . it is too late for a motion for summary judgment. You need 20 days between the motion and hearing. At trial you can move for a directed verdict at the close of the plaintiff's case.
