My brother,sister and I were left on the deed to our parents house when they past away. My brother was and still is living in the home. My sister and husband moved in later. The sister decided to pay half the bills during her time there. The husband has been a problem and now would not pay half the bills.My question is how can we have him removed from the premises since he has been causing problems and has decided not to share the expenses like utility etc. My sister does not work and this man controls her so he refuses to leave until my sister gets her whole share in which we can't do at this time. I do not live in this house but my brother and I would like to have him out since he is the only one with a problem?

She owns 1/3. Buy her out. You are entitled to a credit for her share of expenses that you are paying.

As tennants in common they have a right to stay there as long as they want to. The only way you can force her to leave is to move to partition the house (sell it and divide the money) or to buy her out.
