Chapter 13, Foreclosure, and Surrendering Property

We filed for Chapter 13 in October and our primary mortgage lender started foreclosure proceedings shortly thereafter. We have since been notified that on Jan. 3, 2007, a judge will issue a ruling. Since we filed for Chpt 13 and have notified the bank that we are surrendering the house, what happens to the foreclosure proceedings and show we show up for the scheduled court date?

Seems to me that you forgot (?) an important procedural step here...did the mortgage company seek permission from the bankruptcy court to proceed in state court? Where do you live?
