Legal Question in Real Estate Law in Illinois

Partition & Foreclosure Suit

A sibling and I own 2/3 and an aunt owns 1/3 of the family farm. The aunt filed a foreclosure and partition suit against us. She has never chipped in her part of the taxes during her time as owner. We offered her a fair market value for her 1/3, but she refused. How can we keep the land so we can farm it when she is not being at all cooperative at being bought out? Is there any way to keep it from being auctioned off to someone else?

Re: Partition & Foreclosure Suit

It is almost impossible to answer your question without reading the foreclosure complaint. I would recommend that you run to your family lawyer with it. If you don't have a lawyer, get a referral from your county bar association. Good Luck.
