return of downpayment on house/changed agreement after she cashed check

Do i have any legal right to try and get back my families down payment of 10% = $3300.00. The other person changed the agreement after she cashed the check. It was to be a rent to own. When we were to sign the agreement, i read it and it said a month to month rental agreement. I refused to sign it. And she would not give a copy to us. We are poor and are in need of this money back. The way i see it she stole the money form our children and took away our home. Any help would be very helpful.

Hello. You should contact an attorney as soon as possible. If you don't have a family attorney, you should contact the local bar association for a referral. If you qualify, you might consider contacting the Legal Aid society in your county. I wish you good luck.

If you qualify for legal aid you should try to obtain an attorney that way. Otherwise, you can file in Small Claims Court. I beleive that you can find some good information on how to do that at the Southern Illinois Law School Web Site.

Next time, keep a copy of anything you sign even if the other side has not signed yet.
