Legal Question in Wills and Trusts in Massachusetts

The heirs are to SP who died in 2000, the father. his son JP was the executor of his will, but JP never probated the will or filed the will as required by 2-516, he kept the SP will in safe deposit box concealed from all and then took his fathers stocks and lived on them until he died in 2019. there is no legal document showing the transfer of the stocks to JP. the father gave all of his property to JP and his heirs and assigns. Under Mass. MUPC 266/39 this is fraud and subjects JP to punishment but he is dead now. the wills were found after he died. we want to remove JP because of fraud and unclean hands from his father's will. this is in Mass. looking for case law or other legal support.

This is a very unfortunate situation. I don't understand what it is you want to do since JP is deceased. In any event, this website is to get basic questions answered, not for someone to do research.

Good luck.
