Suing someone in small claims court.

Can i suie someone for damages to my car caused by the oil filter coming loose after 4 months/4000miles? I had a mechanic state that the filter was not installed correctly. The guy who did the work states that if it was put on wrong it would have failed imediatly not 4 months/4000miles. He says other mechanics state the same and once it was on correctly for 3mo/3000+ mi. If anything failed it was not the installation job but the filter itself. they state i drove too long between services. And drove the vehicle with low oil to long at thats what damaged my car and that there would have been warnning signs of a oil leak long before engine damage would have happend. I just want to know what my options are.

A lawsuit would be ddifficult. You would have to sue anyone who came into contact with the vehicle from the manufacturer to the dealer to anyone who serviced the vehicle. Certainly a defense would be any negligence on your part with regard to service.

Depending on the value of the damage, you may have a case where it would cost more to litigate than it would to simply pay for the damages.
