Legal Question in Employment Law in Missouri

Possible Wrongful Termination

Do I have a legal claim (and where do I file) if was was terminated without reason by employer (they still refuse to give me a Letter of Dismissal) and I believe this was because they knew I was going to file an OSHA claim because they would not correct a major situation? And because I had complained to an upline supervisor about my supervisor creating a volatile work environment by yelling at others all the time, and screaming at me on one occasion. He forbid me to ''stick my nose in where it didn't belong'' and said he would ''see to my dismissal'' if I told anyone outisde our office of the conflicts, even made me sign a document stating that I would keep issues within the office. Now they want me to accept $2,270 and sign a release? Can anyone help me?

Re: Possible Wrongful Termination

I would strongly recommend that you consult with an employment law attorney. There are claims available to employees who are terminated for being "whistle blowers." You may fall under the whistle blower category if you were fired for reporting an OSHA claim.

Also, you may have some other cause of action relating to your termination if you were working under an employment contract or were terminated for a reason that is proscribed by statute.

However, at this point, it is not possbile to evaluate whether or not you have a claim because I do not have all of the facts. I would be happy to look into this matter further and determine whether or not you have a potential employment claim. Please do not hesitate to contact me if I can be of assistance to you.
