Legal Question in Civil Litigation in Nevada
pool companies gone bad
I am having a problem with my pool company. We started our pool in april 00, and it is all most completed except there is a leak, they have failed to put our oxidizer and catalyst on. We continue to call the company daily since the end of june and they keep tell us there is a work order out or that they don't have a special screw driver. our pool was completed so I gave the the rest of the checks - the next day they were supposedly coming over to put the oxidizer and catalyst (special cleaning systems) on our pool- the person who was going to do it had car trouble and said she would be there the following day- and has since failed to do so. We then developed a leak which they fixed about a week after we called on it. then it started leaking again. we have are constantly calling the company trying to get this 1000 dollar catalyst and oxidizer on and to get the leaked fixed. We are not even suppossed to be running the filter on the pool with the leak- do you have any advice for me?

Re: pool companies gone bad
Representing a number of pool companies and associations, you have four primary options in the event the pool company fails to voluntarily comply. 1) contact the Nevada State Contractor's Board and seek its assistance. Pool companies have come under greater scrutiny lately from public entities and should want to avoid this exposure. The Board's enforcement power, however, is sometimes suspect. 2) Contact the pool company's license bonding company, in the event it has one, and request it to fix the problems. 3) Have an attorney issue a demand letter. This sometimes work as evidence to the contractor that the homeowner is really serious and taking the matter up a notch. 4) file a complaint in small claims court or justice court.
Other options may be available depending upon the specific company with whom you are working. Some companies, of course, are more reputable than others.
