Legal Question in Consumer Law in New Jersey

I am currently renovating my house. I have a contract with the builder who gave me a $4,800 allowance on the kitchen/ (3) bathroom tiles. I went to a tile store that he recommended and made my selection. I told Nancy, the sales girl, that we would be purchasing the tiles from her and to let us see the retail invoice and layouts she sketched. At that time, she didn�t have pricing and the square footage to give me a price. I wanted to make sure it was in my price range. Unfortunately when I called back Nancy, she said all the information had to go the builder because the account is setup in his name and I would have to get the information from him directly. I asked the builder and they gave me the retail pricing with 10% discount but said if I wanted to purchase directly from the tile store I would only get the retail price. Today, I stumbled upon a 25% off in stock store coupon from the tile store but they are refusing to honor it or to even speak to me about my purchasing direct because the contractor does a lot of business with them. Can they do this or do I have to bring my tile business elsewhere?

Call me, and I will help you straighten this out. You will probably need to come to my office, and show me all of the documents. That includes your contract with the builder, and all the order forms and all other papers from the tile store.

It sounds like this tile store is being foolish and may lose your business. Based on what you wrote, I cannot tell whether you are under any contractual obligation to use a specific supplier.
