Legal Question in Family Law in New Jersey

Take action within 35 days of papers recieved.

The letter says i need to take action 35 days after my receipt of this letter.. one way or the other..

Question is:

I've been residing in Califonia for the past 4 months for work, (have recieps to prove it), plus, my wife's lawyer sent the divorce papers to my california work address. Does this mean i might have 60 days to respond?

You have 35 days to answer a New Jersey complaint for divorce PERSONALLY served upon you, no matter where you were when service was effected.

You have to file an answer and fight this. You need a lawyer, and you need a lawyer now. Bad things will happen to you if you do not, worse than if you take action to deal with it.

Hi,

I am not sure how you were served, but you have to respond to this within 35 days of receiving the complaint. If you do not respond, your wife will have default entered against you, meaning she can proceed without you defending the case. She would then get it scheduled for an Equitable Distribution hearing, and perhaps get other interium relief.

As the other attorneys have said, you have 35 days to respond and I suggest you do so ASAP. Since you are not in NJ, you cannot rush right into my office so I suggest you give me a call at 732/247/3340.
