Legal Question in Insurance Law in New Jersey

Auto Theft Insurance Claim

Our 2002 Nissan Altima was stolen in 5/2007. In October 2007 Allstate denied our claim saying that our car could not be stolen since it is equipped with a transponder system. Basically accusing us of faking the theft and stealing our own car. THey did an investigation using ''theft experts'', who one of the ''theft experts'' is now in jail for disribution of narcotics. What recourse do we have?

Re: Auto Theft Insurance Claim

sue your insurance company for not paying the claim as they should under the insurance contract.

maybe add a claim for punitive damages if they have no basis for doing this.

possibly consumer fraud, but I am not sure you can claim this or not.

if you have tried and they will not pay, find a lawyer who litigates and sue them.

the problem is that the car was not worth a whole lot of money, and you do not want to end up spending a whole lot of money on a lawyer if you do not get those attorneys fees back.
