Legal Question in Workers Comp in New York

is supeana legal?

Recently, my doctor's office received a supeana from my WC carrier's attorney requesting all my medical records. Is this legal without my written release or permission? This doctor that I am seeing my HMO is paying the bill, the carrier is not, they denied his services.

Re: is subpoena legal?

I received your post on 6-29-2001.

Any subpoena must be honored or else a Motion to Quash is in orderby yopu to prevent it's effect. No authorization is required as the attorney acts as an officer of the court.

Good Luck
