Saturday Court Date
My wife recently got a DUI in Ohio. I believe the law requires a her to appear for a hearing within 5 days. The hearing was scheduled for Sat. 12/3/05...I think the cop thought there were 31 days in Nov. Is this a technicality that could lead to the court throwing it out?

You were not clear enough in your question as to whether this was the first hearing she has been provided. Did she appear in a video arraignment the morning after her arrest? How did she get out? Who set the bond?
NOnetheless, call the court now to re-schedule at the very least.

Although she may have other defenses, I'm almost certain that the court won't dismiss the case based upon such a minor technicality. She should contact the court or check online in order to make sure when her arraignment is.
