Lawsuit against estate & fees....

If a malpractice lawsuit is filed after a physician dies on the estate.....

What happens if the legal fees exceed the amount that remains in the estate or if the plaintiff ''wins'' a substantial amount not covered by malpractice insurance? Are the heirs personally responsible for any outstanding payments/claims?

Sons are not held responsible for the sins of the father... But, as you say, the estate could be held liable as could the insurance company. You might also try filing suit against the hospital, the doctor's medical group, or any other organizations that may still be going after the doctor has died.
