i moved away from sd a yr1/2 ago and am taking care of my elderly father, husband keeps talking about abondement & he has verbally abuse me,has a girl that is i love with him and i just want out. i have been permentaly laid off and looking for work in ind & he is still in sd. i want out and he wants out of the marriage. the only thing that we have to fight over is the house and house items. what can i do?

You can file for dissolution. You would have to determine whether you would rather file in Indiana or South Dakota as both courts have jurisdiction.

If there is no battle over the house and belongings, Indiana would be preferred for you.

If there is going to be a battle, then S.D. may be the better jurisdiction as enforcement of the order will become an issue.
