Repossession of deceaced auto

My mother passed away in December, My father who has been caring for here the past two years does not have the money to pay for her car. He returned the auto to the finance company. This car was not in his name (loan contract was only in my mothers). The fiance company has sold the car and is now seeking the difference between the auction sale and the payoff. They are mailing a request for payment to my mother (again who is deceased). My father cannot afford the amount. What if my father does not pay the balance. My mother has no estate. Her name is on nothing of my fathers (i.e. house in only in my fathers name, no joint accounts. He resides in Texas

On the facts you state, I don't think the finance co. can look to your father for payment. good Luck
