Can a spouse ask for a portion of military retirement if I only served seven years in the military and am know longer in the service? I have been out of the military for two years now and do not even qualify for retirement, but I am being asked to sign a DRO giving my spouse %50 of my military retirement should I ever decide to get back into the military one day and retire. I know the USFSPA applies to military and retires but can find nothing about someone who isn�t in the military or retired at the time of divorce.

Even if you went back in, your current spouse would only have a claim based on the seven years you were married to her. You need a good family law attorney. Quit trying to represent yourself. Signing anything before you get one could cost you big bucks in the long run!
