Legal Question in Family Law in Texas

Military Divorce/ Family Law

Can a spouse ask for a portion of military retirement if I only served seven years in the military and am know longer in the service? I have been out of the military for two years now and do not even qualify for retirement, but I am being asked to sign a DRO giving my spouse %50 of my military retirement should I ever decide to get back into the military one day and retire. I know the USFSPA applies to military and retires but can find nothing about someone who isnt in the military or retired at the time of divorce.

Even if you went back in, your current spouse would only have a claim based on the seven years you were married to her. You need a good family law attorney. Quit trying to represent yourself. Signing anything before you get one could cost you big bucks in the long run!
