My father past away and my mother applied for his pension benefits and they denied her the benefits because they had got a legal divorce but they still stayed together.What would be the next step in approaching this matter.If they wont give to her will they give to his 5 children?

She and you all need a lawyer...if they continued living together in Texas ..it is probably a common law marriage...
