Legal Question in Employment Law in India

We are a inspection and testing agency in India and located in Kolkata and are not covered in the schedule of employment under minimum wages act. We work in the premises of our clients across india We have a subsisting wage agreement with our employees and outsourced workmen are also paid on the same scale of pay as applicable to permanent employees. We have been ensuring minimum wages declared by WB Govt in respect of industries not specifically mentioned. We render environment related monitoring service and our services are in no way connected to the manufacturing process / final product. We have been recently been approached by one of our clients to pay wages as applicable to their industry which is Paints and chemicals where we work for 4 days in a month. We utilise the same personnel in other industrial premises on the balance days and no fixed personnel are there who work for the client. What wages are to be paid to be paid. Obviously the rates applicable to paints and chemicals are hiher than what we pay to our employees. Please advise. Regards Chiranjit Sen

Dear Chiranjit,

The minimum wages applicable to West Bengal are Rs. 5,000/- per month plus overtime on a five day week basis since you are engaged in the fumigation business. Registration of your Company under the Factories Act is recommended.
