If he was at fault, your daughter (if 19 or over) has a right to file a lawsuit against him for damages to the vehicle and her injuries. If she is 18 or younger, she can so through you as her mother and next friend. What also needs to be considered is what uninsured motorist coverage she had on her own insurance policy, assuming she had coverage.
