Legal Question in Medical Malpractice in Arizona

Wrongful Death/Malpractice

In 1986 my husband was admitted to the Mental Ward of our local hospital while I was at work. While there he stated to doctors that he was going to kill himself and that he planned to kill my daughter and I as well before he took his own life. Despite these statements,there was no warning given of danger to me. He did commit suicide a couple of days after his release and he did come looking for my daughter and I. We just happened to not be where he came looking. I did not know about the details of his plan to kill us as himself until about 4 years later when I obtained the medical record. I assume that for me the statute of limitations has passed, but for my daughter who is now 21, could a suit be brought against the hospital for this as wrongful death/malpractice? We went through serious mental anguish, medication, therapy and both of us have been diagnosed with PTSD relating to his death.

I am sorry to say it appears the statute of limitations has run for both of you. Your daughter would have had to file within 2 years of her 18th birthday.
