Legal Question in Disability Law in California

Terminated while on disability

I am currently on disability and have been since Sept 2005. I am scheduled for cervical spine surgery in a couple of weeks. I am still on short term disability until next week and I received a conference call from my boss and human resource manager yesterday telling me I'm being terminated. Can they do that?

Yes, once you exceed the company max disability leave policy limits, and the FMLA and other mandated periods. Some companies will offer return once you are released, but they are not required to.
