Legal Question in Family Law in California

Not paying child support

Dear Sir/Madam,

My ex- has not paid child support more than a year. His excuse is that he does not have a job now, but he has $400,000+ in his account. I am not sure if he has a job or not. Maybe he is working part-time or on a project. I do not have prove at this time.

My lawyer does not do anything except charging me. My understand is that he can go to jail if he does not pay child support. Any advice is very welcome.

I really appreciate your help!

Sincerely,

San Mateo, CA

Re: Not paying child support

Hi,

There are several options available to enforce your children's rights. For instance, you can seek a lien against your ex-husband's bank account and request contempt sanctions.

Since you expressed dissatisfaction with your attorney, please be advised that a client is always free to seek new counsel.

Call me if you need more information.

Very truly yours,

Russ

Reply: Not paying child support

In a general sense, if your former spouse has $400,000 sitting in an account and at the same time owes you back support, you can execute against the account and receive the past due support plus statutory interest.

For a specific opinion regarding your individual circumstances, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
