Legal Question in Employment Law in California

Employee Liablity

My girlfriend works for a record store and anytime cd's are missing or money is missing from the register she has to put it back out of her own pocket. She also works 11 hours of friday's, alone, which she doesn't get paid overtime for and for lunch she can't close the store she has to eat at the register standing because there's no chair or stool to sit. is this illegal?

Re: Employee Liablity

Pretty much everything you describe is illegal. Employers can't make employees pay for losses, must provide for meal and rest breaks and must pay for overtime to non-exempt employees. Direct your girlfriend to the nearest Labor Commissioner's office for assistance.

Re: Employee Liablity

She is entitled to OT and to lunch and breaks. She may not be charged with losses unless proven to be her theft or misconduct. She can file a claim of unpaid compensation for all those, with the Labor Commissioner. She is entitled to have an attorney represent her in the process and at the hearings and trial. Have her contact me if interested in doing so.
